INTRODUCTION

In India, being a welfare state, any offence committed against individual is deemed to be committed against society. State takes the responsibility to prosecute the offender as per the law. In criminal justice system, the Prosecution i.e. State becomes an important stake holder. As per our criminal jurisprudence, Prosecution has to be effective so that the offender/wrongdoer can be appropriately punished by the court of law. Rule of law can only be ensured by dealing effectively with the wrongdoer in accordance with law. With this objective the Directorate of Prosecution was established in 1980 in Uttar Pradesh under the administrative control of Home Department.

Function of Directorate is to have administrative control over the officers of State Prosecution Services. It has to monitor the work of Additional Director Prosecution, Joint Director Prosecution, Senior Prosecuting Officer, Prosecuting Officer and Assistant Prosecuting Officer working in the Prosecution Department.

The organization structure of Department of Prosecution is as follow:

  • Director Prosecution
  • Additional Director
  • Joint Director
  • Senior Prosecuting Officer
  • Prosecuting Officer
  • Assistant Prosecuting Officer

For administrative purposes, there are 18 regions. Every region is supervised by Additional Director Prosecution. At district level Prosecution Department is headed by Joint Director Prosecution. The Prosecution work in the court of law is performed by Senior Prosecuting Officer, Prosecuting Officer and Assistant Prosecuting Officer. The Prosecutors also provide legal opinion to the investigating officers and offices of the other State Government Departments.

Officers of prosecution department are also appointed in other branches of Police Department where they extend legal opinion. Prosecuting Officers are also posted in Hon’ble Allahabad High Court at Prayagraj and Lucknow bench.

At the Directorate level, IPS officers of the rank of IG/DIG are also posted to assist in Administrative work. Additional Director (Law) assists in monitoring writs, providing legal opinion to Home Department and constantly checking the status of cases in various courts across the state. Accounts Officers assist in budget preparation and expenditure control.

Latest initiatives include formulating an “App”, linking it with CM Portal, upgradation of Sadar Malkhana, establishing VC rooms for recording of evidence, Cadre Review and upgradation of service condition of officers and staff.
