Poisonous Liquor
Uttar Pradesh Excise Amendment Bill will curb illegal liquor trade. Through this, the Excise Act 1910 has been amended and a new section '60A' has been added. However, its ordinance has already been issued in September.
More than two dozen sections of the Excise Act 1910 have been amended through the bill. Sections 30, 50, 51, 52, 53, 54, 55, 60, 62, 63, 64, 64A, 65, 66, 67, 68, 69, 69A, 70, 71, 72 of the Act were amended through ordinance in the month of September. , 73A, 74 and 74A were amended. Also a new section ‘60A’ was added.
There is a provision of life imprisonment or a fine of Rs 10 lakh or both, or even death penalty in case of death or permanent disability due to illicit liquor. Due to amendment in Section 30 of the Excise Act, the liability of tax on the amount of consideration duty being taken carelessly by the State Excise Department has come into effect from April 1, 2016.
The powers of officers have been increased through this bill. In this, the power to arrest, detain and seize liquor from the accused has been increased. Similarly, the rules regarding arresting the accused by obtaining warrant, search warrant, right to search without warrant, arrest process, illegal liquor smuggling, transportation and production of illegal liquor have also been amended.
